Family legal matters are often contentious and can be emotionally exhausting for all involved. Mediation seeks to ease this conflict and encourages families to reach an amicable and mutually beneficial agreement. At Pucci Pirtle, we are especially committed to helping your family find the peaceful resolution you desire. We are experienced in working directly with clients, attorneys, and other mediators to always put your best interests first.
What is Mediation?
Mediation is an alternative dispute resolution (ADR) technique that encourages families to peaceably resolve their legal problems with effective communication and creative solutions. It can be used to help families with legal matters pertaining to divorce and child-related issues, such as allocation of parental responsibilities (or child custody), parenting time (formerly known as visitation), and parentage. Each party is given the chance to voice their concerns during the process, but the environment is usually less contentious than a courtroom setting. It is generally most beneficial for families and couples who are willing to communicate and cooperate but are struggling to work out the complexities or details of their case.
Families who can successfully use mediation often report greater satisfaction with the outcome of their legal matters than those who seek to resolve matters in court. This may be due, in part, to the wide range of benefits that mediation can offer, such as:
- Lower overall cost when compared to in-court proceedings;
- Privacy regarding their legal matter;
- Less time-intensive than traditional litigation;
- More control over the topics discussed;
- Greater flexibility regarding the end-solution;
- The chance to reduce conflict and protect children from its negative effects;
- More scheduling flexibility; and
- A chance to have their voices heard.
Keep in mind, however, that mediation is usually utilized in conjunction with some sort of litigation and is never a substitute for hiring an attorney. In addition, mediation may not be suitable for every family, or for every situation. Alternatively, some families may attempt mediation but ultimately fail in reaching a mutual agreement. In either of these cases, you must seek resolution through the traditional court system. Our legal team is committed to being the type of advocate you need most, and we can assertively represent you if litigation is required.
